Terms of service

These terms govern every order placed on Zuvo Goods, the online shop operated by Mondeaux. By placing an order you accept them. They are governed by Dutch law, and by the Australian Consumer Law where that gives you stronger protection as a consumer resident in Australia.

Article 1 — Definitions

  • Consumer: a natural person acting for purposes outside their trade, business or profession.
  • Seller: Mondeaux, operating the online shop Zuvo Goods.
  • Distance contract: a contract concluded without the parties being physically present together.
  • Business day: Monday to Friday, excluding public holidays.
  • Order: a request to buy one or more products, placed through the shop.

Article 3 — Scope

These terms apply to every offer we make and every contract concluded between us. They are available on this page at all times and can be saved or printed.

If a provision turns out to be invalid, the rest stays in force and the invalid provision is read as closely as possible to what was intended.

Article 4 — Products and descriptions

Each product page describes the item in enough detail for you to judge it properly. Photographs are as faithful a representation as we can manage; small differences in colour caused by your screen are not a defect.

Measurements given for clothing are the measurements of the garment, not of the wearer, and may vary by a centimetre or two between individual pieces.

Obvious errors in an offer do not bind us.

Article 5 — Prices

All prices are in Australian dollars and are the final price you pay. Shipping to Australian addresses is free. We are not registered for Australian GST, so no GST is charged.

We may change prices at any time, but the price shown when you place an order is the price that applies to that order.

Article 6 — Formation of the contract

The contract is formed when you place an order and we confirm it by email. Until that confirmation is sent, no contract exists.

We may refuse an order, or attach conditions to it, where we have reasonable grounds — for example a history of unpaid or fraudulent orders, or an address we cannot deliver to. We will tell you within five business days and refund anything already paid.

Article 7 — Payment

Orders are paid in full at checkout. We accept the methods shown on the payment page and at checkout. Payments are processed by our provider over an encrypted connection.

You are responsible for the accuracy of the payment details you give us.

Article 8 — Delivery

We deliver to Australian addresses. Orders are prepared within 1 to 5 business days and normally arrive 8 to 14 business days after you order. These are estimates, not guarantees; the shipping policy sets out the detail.

Risk of loss or damage passes to you when the parcel is delivered to the address you gave — not before. A parcel lost in transit is our problem, not yours.

If we cannot deliver within thirty days and we have not agreed a longer period with you, you may cancel the order and we will refund you in full.

Article 9 — Returns and refunds

You may return an item within 30 days of delivery under the conditions set out in the refund policy. That policy forms part of these terms.

Article 10 — Consumer guarantees

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these terms excludes, restricts or modifies those guarantees.

Article 11 — Using the products

Use each product for its intended purpose and follow the instructions supplied with it. Products for animals should be fitted with the animal present and checked for fit; no garment or harness should be left on an unsupervised animal.

Electrical products should be used with the supplied cable or adaptor and kept away from water unless the product page says otherwise.

Article 12 — Our liability

We are liable for loss or damage caused by our failure to meet a consumer guarantee, and for anything else the law does not allow us to exclude.

Beyond that, our liability is limited to the value of the order concerned. We are not liable for indirect or consequential loss such as lost profit or lost time, except where the Australian Consumer Law says otherwise.

Article 13 — Force majeure

We are not in breach of these terms where performance is prevented by something outside our reasonable control, including carrier failures, customs delays, natural disasters, industrial action or the loss of a supplier. Where the situation lasts more than sixty days, either party may cancel the affected order and we refund in full.

Article 14 — Intellectual property

The text, layout and arrangement of this shop belong to us and may not be copied for commercial use. Product photographs are supplied by the manufacturers and remain theirs.

Article 15 — Your account

If you create an account, keep the password to yourself. Tell us as soon as you suspect someone else has used it. We may close an account that is used to abuse the shop or its staff.

Article 16 — Complaints and disputes

Send complaints to info@zuvogoods.com with your order number. We acknowledge within one business day and answer within fourteen days; if we need longer we will say so and tell you when to expect an answer.

If we cannot resolve it, you may contact the consumer protection agency in your state or territory, or the Australian Competition and Consumer Commission at accc.gov.au.

Article 17 — Governing law

Dutch law applies to these terms. As a consumer resident in Australia, you keep the protection of the mandatory provisions of Australian law, including the Australian Consumer Law, and you may bring proceedings in the courts of your place of residence.

Article 18 — Changes to these terms

We may change these terms. The version in force when you place your order is the version that applies to that order.
